SHIPPING & DELIVERY POLICY

This Shipping & Delivery Policy applies to purchases of alcoholic beverages made through the website located at www.thewhiskeylab.com (the “Site”). This Policy supplements and is incorporated by reference into The Whiskey Lab’s Terms of Service.

The Whiskey Lab, LLC (“The Whiskey Lab” or “TWL”) operates the Site as a marketing, brand, and commerce facilitation platform. The Whiskey Lab does not sell, ship, deliver, or fulfill alcoholic beverages.

All alcoholic beverage orders placed through the Site are accepted, sold, fulfilled, and delivered by a properly licensed third-party retailer located in Washington, D.C. (the “Retailer”), which acts as the sole seller of record for all such transactions.

When you place an order through the Site, you are purchasing directly from the Retailer. Payment is made to the Retailer or its authorized payment processor, and the Retailer is solely responsible for order acceptance, fulfillment, shipping, delivery, package protection offerings, and compliance with applicable law.

Place of Sale and Title Transfer

All sales of alcoholic beverages are deemed to occur in Washington, D.C. at the Retailer’s licensed premises.

Title to and ownership of alcoholic beverages pass from the Retailer to you at the Retailer’s licensed location in Washington, D.C., prior to shipment, in accordance with applicable law.

By placing an order, you authorize the Retailer, acting on your behalf, to arrange shipment through a common carrier to your designated delivery address where permitted by law.

The Whiskey Lab does not take title to, store, warehouse, ship, deliver, or physically handle alcoholic beverages at any time.

Shipping Availability and Geographic Restrictions

Shipping is available within the United States only where permitted by applicable federal, state, and local law.

The Retailer determines shipping eligibility and reserves the right to decline, cancel, or refuse orders that cannot legally be shipped to a particular location.

Shipments are not available to certain states, and additional restrictions may apply at the county, municipal, or ZIP-code level. Eligible destinations are reflected at checkout, and availability may change without notice based on legal or regulatory requirements. If your address is not eligible, the Site will not permit the order to be placed.

Age and Legal Compliance

By placing an order, you represent and warrant that you are twenty-one (21) years of age or older and that the purchase, shipment, receipt, and possession of alcoholic beverages at your delivery address are lawful.

Age verification and legal eligibility verification are performed by the Retailer and its authorized carriers. Orders that fail age or compliance verification may be refused, canceled, or returned in accordance with Retailer policy.

Adult Signature and Identification Verification

All alcohol deliveries require an adult signature from an individual twenty-one (21) years of age or older. Carriers will not leave packages unattended.

A valid government-issued photo identification may be required upon delivery. Failure to provide acceptable identification or to accept delivery may result in the return of the shipment to the Retailer and the assessment of applicable return, restocking, or reshipment fees pursuant to Retailer policy.

Order Processing and Transit Times

Please allow up to three (3) business days for the Retailer to process your order prior to shipment.

Express or expedited shipping services may be offered but are not guaranteed. Carrier transit times begin only after order processing is complete.

Processing and transit times may be extended due to order volume, compliance reviews, carrier delays, weather conditions, or other circumstances beyond the Retailer’s control. Tracking information will be provided once the order has shipped.

Package Protection

At checkout, you may choose between two shipping options: a standard rate without Package Protection, or a rate that includes Package Protection for an additional fee based on order value.

Package Protection is an optional service guarantee offered by the Retailer. It is not an insurance policy, and neither the Retailer nor The Whiskey Lab is an insurer. When you select a shipping option that includes Package Protection, the Retailer guarantees your order against loss, damage, and theft while in transit, subject to the terms below.

What Package Protection covers

Orders shipped with Package Protection are covered for: packages lost in transit (no delivery and no tracking movement for ten (10) or more days); packages damaged in transit, including broken bottles or compromised seals; packages marked delivered but stolen before receipt; and packages discarded or destroyed by the carrier.

What Package Protection does not cover

Package Protection does not cover: delivery delays; orders shipped to an incorrect address provided at checkout; packages refused at delivery or returned because no adult (21+) was available to sign after the carrier’s delivery attempts; cosmetic damage to outer retail packaging where the bottle itself is intact; or claims reported outside the windows below.

How to file a claim

Email fulfillment@thewhiskeylab.com with your order number. For damage claims, include photographs of the bottle, inner packaging, and shipping box, and report within seven (7) days of delivery. For loss or theft claims, report within thirty (30) days of the ship date. Retain all packaging materials, as photographs or inspection may be required. Claims receive a response within two (2) business days.

Remedy

Valid claims on protected orders receive a free replacement of the original item, shipped at no cost to you. If the item is no longer available, a comparable substitute or a full refund of the item price will be offered, at your choice. Limit one replacement per order.

Orders shipped without Package Protection

If you select a shipping option that does not include Package Protection, your order ships at your own risk once it is transferred to the carrier. Orders shipped without Package Protection are not eligible for free replacement or refund for loss, damage, theft, or carrier disposal occurring in transit, beyond what is required by applicable law. The Retailer and The Whiskey Lab will assist with carrier claims where possible and may offer discounted reordering, but transit losses on unprotected shipments are not eligible for free replacement.

Weather Holds and Quality Protection

To protect product quality, the Retailer may temporarily hold shipments during periods of extreme heat, cold, or adverse weather conditions.

Weather holds are applied at the Retailer’s discretion and may delay delivery. Neither the Retailer nor The Whiskey Lab guarantees delivery timelines during such periods.

Delivery Attempts, Returns, and Reshipments

Carriers typically make multiple delivery attempts before returning an order to the Retailer.

If an order is returned due to missed delivery attempts, failure to provide identification, incorrect address information, or refusal of delivery, the Retailer may charge return shipping, reshipment, restocking, or handling fees in accordance with its policies.

Address changes, rerouting requests, or delivery modifications after shipment may not be possible and may result in additional charges or cancellation.

Damaged, Leaking, or Incorrect Items

You should inspect your package promptly upon delivery.

If your order arrives damaged, leaking, or incorrect, contact fulfillment@thewhiskeylab.com with your order number, or follow the instructions provided in your order confirmation. All packaging materials should be retained, as photographs or inspection may be required.

For orders shipped with Package Protection, claims are handled under the Package Protection terms above. For orders shipped without Package Protection, see “Orders shipped without Package Protection” above.
