WHISKY TOUR TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern participation in whisky tours and related experiences (the “Tour”) organized by The Whiskey Lab LLC (“TWL,” “we,” “us,” or “our”). By booking or participating in a Tour, you (“Participant,” “you”) agree to be bound by these Terms.

1)  Booking and Payment

a)     Full Payment Required
Full payment is required at the time of booking to secure a place on the Tour. Participation is confirmed only once payment has been received and acknowledged by TWL.

b)    Invoices
All payments are made pursuant to invoices issued directly by TWL. Invoice due dates are strictly enforced. Failure to remit payment by the stated due date may result in cancellation of the booking without refund.

c)     Final Sale
All bookings are final. No refunds will be issued for any reason, including but not limited to cancellation, illness, injury, travel delays, personal emergencies, weather conditions, itinerary changes, missed activities, or inability to attend.

2)  What Is Included and Excluded

a)     Included
The Tour includes curated distillery visits, accommodations, and whisky experiences as outlined in the published itinerary, along with trip planning and on-the-ground coordination by TWL.

b)    Not Included
Unless explicitly stated in writing, the Tour does not include:

i)      Flights or airfare

ii)    All Meals or beverages beyond those included in distillery experiences

iii)  Travel, medical, or personal insurance

iv)   Personal expenses, including bottles, merchandise, or souvenirs

3)  Ground Transportation

a)     Limited Transportation Services
TWL may provide limited ground transportation during the Tour, including transportation by passenger van driven by a TWL representative. Ground transportation is provided solely as a convenience and as part of the curated experience.

b)    No Common Carrier
TWL is not a common carrier, taxi service, limousine service, or commercial transportation provider. Routes, timing, seating, and stops are determined at TWL’s discretion based on itinerary needs, safety considerations, and local conditions.

c)     Participant Conduct
Participants must comply with all safety instructions while in the vehicle, including seat belt use where required by law. TWL reserves the right to refuse transportation to any Participant who is intoxicated, disruptive, unsafe, or noncompliant, without refund.

d)    Assumed Risk
Participants assume all risks associated with ground transportation, including traffic conditions, weather, road conditions, and the conduct of third parties.

4)  Itinerary and Experience Availability

a)     Subject to Availability
All distillery visits and experiences are subject to confirmation and availability by host distilleries and third-party providers.

b)    Changes and Substitutions
TWL reserves the right to modify the itinerary or substitute experiences of comparable quality due to availability constraints, operational needs, weather, safety concerns, or other circumstances beyond TWL’s control.

c)     No Refunds for Changes
No refunds will be provided for itinerary changes, substitutions, or missed experiences.

5)  Cancellations and Transfers

a)     No Participant Cancellations
Participant cancellations are not eligible for refunds.

b)    Transfers
A booking may be transferred to another individual only with prior written approval from TWL. TWL reserves the right to refuse any transfer at its sole discretion.

c)     Late Arrival / Early Departure
No refunds will be issued for late arrivals, early departures, or missed activities.

6)  Participant Responsibilities

a)     Legal Drinking Age
Participants must be of legal drinking age in all applicable jurisdictions.

b)    Conduct and Compliance
Participants are responsible for their own conduct and must comply with all local laws, distillery rules, and safety instructions. Excessive intoxication, disruptive behavior, or failure to follow instructions may result in removal from activities without refund.

c)     Personal Property
Participants are responsible for safeguarding their own belongings and purchases. TWL is not responsible for loss, theft, or damage to personal property.

7)  Alcohol Consumption

Participants acknowledge that alcohol consumption may occur during the Tour. TWL may refuse participation in activities or transportation to any Participant who appears excessively intoxicated or poses a safety risk.

Participants remain solely responsible for their own alcohol consumption and behavior at all times.

8)  Health, Safety, and Assumption of Risk

a)     Inherent Risks
Participation in the Tour is voluntary and involves inherent risks, including but not limited to alcohol consumption, distillery and warehouse environments, uneven surfaces, rural roads, vehicular travel, adverse weather, physical exertion, and interaction with third parties.

b)    Transportation Risk
Participants acknowledge that TWL may provide ground transportation operated by a TWL representative and voluntarily assume all risks associated with riding in such vehicles, except where prohibited by law.

c)     Voluntary Participation
You knowingly and voluntarily assume all risks associated with participation in the Tour.

9)  Release and Waiver of Liability

a)     To the maximum extent permitted by law, you hereby release, waive, and discharge TWL and its members, managers, officers, employees, contractors, agents, affiliates, and representatives (including any individual acting as a driver or tour leader) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to your participation in the Tour, including ground transportation provided by TWL.

b)    This release includes claims based on negligence but does not apply to claims arising from gross negligence or willful misconduct where such release is prohibited by law.

10)      Insurance

Participants are strongly encouraged to obtain personal travel insurance covering trip cancellation, medical expenses, personal injury, and personal property. TWL does not provide travel, medical, vehicle, or liability insurance for Participants.

11)      Photography and Media

TWL may capture photographs or video during the Tour for promotional or marketing purposes. By participating, you grant TWL a perpetual, royalty-free right to use such media unless you notify TWL in writing prior to the Tour.

12)      Force Majeure

TWL shall not be liable for delays, modifications, or inability to perform any portion of the Tour due to events beyond its reasonable control, including but not limited to acts of God, weather, road closures, labor actions, government actions, supplier cancellations, illness, or emergencies. No refunds will be issued for Force Majeure events.

13)      Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles.

14)      Acceptance of Terms

By booking or participating in the Tour, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
